Daiichi Sankyo Receives Favorable Judgment in Damage Claim Filed by
NTK

Tokyo – (September 10, 2026) – As Daiichi Sankyo (TSE: 4568) has previously stated in the press releases
dated November 22, 2023 and May 22, 2025, Northern TK Venture Pte. Ltd. (hereinafter, “NTK”), an indirect
wholly-owned subsidiary of IHH Healthcare Berhad (hereinafter, “IHH”), filed a lawsuit before the Tokyo District
Court against Daiichi Sankyo on October 16, 2023, seeking JPY 20 billion in damages and other relief (hereinafter,
the “Lawsuit”). Subsequently, a motion to amend the claim was filed on May 9, 2025, and NTK’s claim was
expanded to JPY 203,301,807,840.

On September 10, 2026, the Tokyo District Court rendered a judgment recognizing the arguments of Daiichi
Sankyo and dismissing all of NTK’s claims. Daiichi Sankyo hereby announces the judgment.

3. Cause of Lawsuit and Proceedings Leading to Judgment
Based on an arbitral award dated April 29, 2016 against former shareholders of Ranbaxy (hereinafter, “Arbitration
Award”), Daiichi Sankyo has been pursuing enforcement of the Arbitration Award before the courts in India in
accordance with Indian law. In the course of these enforcement proceedings, a tender offer by NTK for Fortis
Healthcare Limited (hereinafter, “FHL”), was suspended pursuant to a decision by the Supreme Court of India.

NTK filed the Lawsuit alleging that it suffered damages, including the suspension of the tender offer due to the
interference of Daiichi Sankyo. In response, Daiichi Sankyo has consistently asserted that NTK’s allegations have
no merit and that the suspension of the tender offer resulted from a decision made by the Supreme Court of India
following due process in the course of the enforcement of the Arbitration Award in India to Daiichi Sankyo.

On September 10, 2026, the Tokyo District Court accepted the arguments of Daiichi Sankyo, determined that
NTK’s allegations had no merit, and rendered a judgment dismissing all of NTK’s claims.

(ii) Request for an injunction against interference with the acquisition of shares and other matters; and
(iii) Demand that a statement prepared by NTK be posted on Daiichi Sankyo’s website and that a document
containing the same statement be submitted to the Securities and Exchange Board of India (SEBI).

5. Details of Judgment
On September 10, 2026, in the Lawsuit, the Tokyo District Court rendered a judgment dismissing all of NTK’s
claims. Daiichi Sankyo considers that this judgment recognizes the legitimacy of the Company’s position and
represents a fair determination.

6. Outlook
At this time, this judgment will have no impact on Daiichi Sankyo financial results. If any additional matter requiring
disclosure arises in connection with this lawsuit, Daiichi Sankyo will promptly make an announcement. In addition,
if NTK appeals this judgement, the Daiichi Sankyo will continue to assert its position in the appellate proceedings.
